Time to Revisit the R&D Tax Credit?

The federal research tax credit ("R&D credit) has been available for 35 years, but many companies fail to take advantage of its significant cash-flow benefits. Some companies may believe that the credit doesn't apply to them; that it's only available to biotech companies or those that conduct laboratory research. In fact, it's potentially available to any business that invests in developing new products, improving processes or techniques, creating software, and a variety of other innovations.

In addition, some companies may have been turned off by the credit's historically temporary nature. Although the credit was revived every time it expired, uncertainty over its continued availability made it difficult for companies to incorporate the credit into their long-term tax planning.

Troubleshooting the Affordable Care Act

Two questions an individual will want to consider about the ACA: 1) If I don't buy health insurance am I going to pay a penalty? And 2) If I can't afford insurance can I get the government to pay for some of it?

If a business has 50 or more full-time employees (or equivalents), it must offer affordable health insurance to all its employees, pay for at least 60 percent of the premiums, and offer minimum essential coverage. If the employer does this, an employee cannot go to the "marketplace" and get the premium tax credit.

Strategies for Minimizing Net Investment Income Taxes

If you're subject to the 3.8 percent net investment income (NII) tax, there may be strategies you can employ to minimize or even eliminate the tax. NII includes many types of income, such as taxable interest, dividends, capital gains, rents and royalties, and certain passive business income.

The tax applies to you if your modified adjusted gross income (MAGI) is greater than $200,000 ($250,000 for married couples filing jointly; $125,000 for married filing separately). For most people, MAGI is equal to adjusted gross income (AGI). Your tax liability is equal to 3.8% of your NII or the amount by which your MAGI exceeds the threshold, whichever is less.

New Audit Rules Will Have a Big Impact on Partnerships

Last year's Bipartisan Budget Act introduces new partnership audit rules that will take effect in 2018. Partnerships -- including LLCs taxed as partnerships -- should pay close attention to these rules. You might assume that audit rules are merely procedural, but the new rules make significant substantive changes, essentially subjecting partnerships to entity-level taxes for the first time.

In a dramatic departure from current practice, the new rules will permit the IRS to collect taxes from partnerships rather than from individual partners. By reducing the administrative burdens associated with partnership audits, the new rules will likely increase the number of audits.
